In manchen F\u00c3\u00a4llen ist die Arbeitsunf\u00c3\u00a4higkeit so schwerwiegend, dass betroffene Mitarbeiter*innen f\u00c3\u00bcr einen l\u00c3\u00a4ngeren Zeitraum ausfallen. Privat stehen dann zahlreiche Besuche bei <strong>\u00c3\u201erzten und Therapeuten<\/strong> an, begleitet von einem Dschungel an Unterlagen und Formularen, die es auszuf\u00c3\u00bcllen gilt. Je l\u00c3\u00a4nger der oder die Betroffene arbeitsunf\u00c3\u00a4hig ist, desto schwerer kann es einem fallen, wieder den Fu\u00c3\u0178 ins Arbeitsleben zu bekommen. Der Fokus wird hier auf die betrieblichen Umst\u00c3\u00a4nde gesetzt. Oft spielen aber auch private Gegebenheiten eine gro\u00c3\u0178e Rolle. Eine Ma\u00c3\u0178nahme kann zum Beispiel sein, dass der betroffene Mitarbeiter nach langer Arbeitsunf\u00c3\u00a4higkeit mit einer reduzierten Stundenzahl an seinen Arbeitsplatz zur\u00c3\u00bcckkehrt, die er dann sukzessive aufstockt: Stufenweise Wiedereingliederung. Oft sind am Arbeitsplatz spezielle Hilfmittel notwendig, die es zu organisieren gilt. Im BEM-Verfahren wird aber auch Unterst\u00c3\u00bctzung angeboten, wenn es um Antr\u00c3\u00a4ge bei \u00c3\u201emtern geht, z.B. bei Leistungen zur Teilhabe am Arbeitsleben, Teilerwerbsminderungsrente oder Antr\u00c3\u00a4ge auf Schwerbehinderung.<\/p>\n<p>&nbsp;<\/p>\n<p>Zentrale Vorschrift f\u00c3\u00bcr ein BEM ist \u00c2\u00a7167 Abs. 2 Sozialgesetzbuch. Ist ein Arbeitnehmer innerhalb von 12 Monaten l\u00c3\u00a4nger als sechs Wochen arbeitsunf\u00c3\u00a4hig erkrankt, muss der Arbeitgeber ein BEM anbieten. Dabei ist es irrelevant, ob der oder die Betroffene sechs Wochen am St\u00c3\u00bcck oder in Summe erkrankt ist. Die Teilnahme des Arbeitnehmers ist freiwillig. Nebendessen ist es auch m\u00c3\u00b6glich, sich f\u00c3\u00bcr erste Fragen an die Arbeitnehmervertretung zu wenden. Der Vorgesetzte ist in den meisten F\u00c3\u00a4llen zu Beginn eines BEM nicht eingebunden.<\/p>\n<p>Das BEM beginnt mit einem Informationsgespr\u00c3\u00a4ch zwischen dem Mitarbeiter und der BEM-Beauftragten. Der Mitarbeiter entscheidet selbst, ob er oder sie Vertreter des Betriebsrates oder aber auch vertraute Personen, z.B. Ehegatten, dabei haben m\u00c3\u00b6chte. Schwerbehinderte Mitarbeiter d\u00c3\u00bcrfen auf die Anwesenheit der Schwerbehindertenvertretung bestehen. Sollte sich im Erstgespr\u00c3\u00a4ch herausstellen, dass man f\u00c3\u00bcr m\u00c3\u00b6gliche Ma\u00c3\u0178nahmen weitere Akteure ben\u00c3\u00b6tigt, wird dies gemeinschaftlich festgelegt. Weitere Akteure k\u00c3\u00b6nnen betrieblich sein, z.B. Vorgesetzte, Betriebsarzt, Fachkraft f\u00c3\u00bcr Arbeitssicherheit, PeMa-Mitarbeiter \u00e2\u20ac\u201c aber auch extern sein, z.B. Daher hat der Datenschutz im BEM eine enorme Bedeutung. Bevor man \u00c3\u00bcber Gr\u00c3\u00bcnde, Ursachen oder Ma\u00c3\u0178nahmen spricht, wird von jedem Teilnehmer (betrieblich oder extern) eine Datenschutzerkl\u00c3\u00a4rung unterschrieben, welche im ersten Informationsgespr\u00c3\u00a4ch detailliert besprochen wird. Jegliche Daten oder Protokolle d\u00c3\u00bcrfen nur mit Einverst\u00c3\u00a4ndnis des Betroffenen weitergegeben werden und werden daher nicht in der Personalakte aufbewahrt. Letztlich entscheidet jeder Mitarbeiter selbst, was er von sich preisgeben m\u00c3\u00b6chte und welche Daten davon erhoben werden.<\/p>\n<p>[\/et_pb_blurb][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=&#8221;1&#8243;
